WHO IS A LANDLORD?
A landlord is an owner of a property such as a house, apartment, land, or estate that is rented or leased to an individual or business, known as a tenant. The law defines a “landlord” as a person who owns a property. This ownership is tied to title in the property but not all the time. Also, a landlord includes a sub-landlord or any person from time to time deriving title/ownership or interest from the original landlord or sub-landlord. This means that a landlord is not only the owner of a property but also the person who purchases the property from the original landlord. The critical thing here is ownership or possession, as the case may be.
WHO IS A SUB-LANDLORD?
A sub-landlord is the person who sublets a property that is rented to him or her. For instance, a tenant in a four-bedroom flat on 21 Road, Festac, can sublet two rooms out of the four bedrooms. In such a case, the tenant of the four-bedroom flat becomes a sub-landlord to his sub-tenant that he rented the two bedrooms. Thus, such a sub-landlord is not necessarily the owner or title holder to the property but is the sub-landlord (landlord) to his sub-tenant (tenant).
DIFFERENCE BETWEEN LANDLORD AND LESSOR
We must bear in mind that a landlord and a lessor are almost the same thing or similar. The difference is that when a property is rented below three years, there is a landlord and tenant relationship between the two parties. However, when a property is rented for three years and above, there is a lessor or lessee relationship.
WHO IS A LESSEE?
A lessee of a property (in what lawyers call long-lease) may be a landlord or sub-lessee but not the owner or title holder of the property. For instance, if Chief Onwa has a 99-year certificate of occupancy or Governor’s consent in a property at 2nd Avenue, Festac, he may decide to lease the property to Otunba Olabiran for 60years. In an ordinary sense, Chief Onwa is the landlord of the property, while Otunba Olabiran is his tenant. This is because Chief Onwa still has 39 years interest (residue of interest) in the property, which will revert to him after Otunba Olabiran’s 60-year lease.
